Section 75 vs Chargeback
| Section 75 | Chargeback | |
|---|---|---|
| Legal protection | Yes (Consumer Credit Act) | No (voluntary scheme) |
| Card type | Credit card only | Credit or debit card |
| Min amount | £100 | No minimum |
| Max amount | £30,000 | No maximum |
| Time limit | 6 years | 120 days (typically) |
| Best for | Larger purchases, company gone bust | Smaller purchases, quick resolution |
Tip: If your purchase is under £100 or you paid by debit card, try chargeback first. You can also use both - try chargeback for speed, then Section 75 if it fails.
How to Make a Section 75 Claim
Try the retailer first
Contact the retailer or service provider to try to resolve the issue. Keep records of all communications. This is not strictly required but strengthens your case.
Contact your credit card provider
Call the number on the back of your card or use their app/website. Ask to make a 'Section 75 claim'. Have your transaction details ready.
Put it in writing
Send a formal claim letter (use our template below). Include all evidence: receipts, correspondence with the retailer, photos of faulty goods.
Wait for their response
Your card provider has 8 weeks to respond. They may ask for additional evidence.
Escalate if needed
If rejected or no response within 8 weeks, complain to the Financial Ombudsman Service (FOS). This is free and independent.
Claim Letter Template
Send this letter to your credit card provider's claims or disputes department.
